What Is Asylum?
Asylum is a form of protection granted to individuals who have fled their home country due to fear of persecution based on the following:
- Race
- Religion
- Nationality
- Political opinion
- Membership in a specific social group
If you are to obtain asylum, you can become a lawful permanent resident (Green Card holder) after one year. You will also be able to bring your spouse and children with you to the country.
Who Qualifies for Asylum?
To qualify for asylum, you must meet several requirements, as outlined by the United States Citizenship and Immigration Services (USCIS).
These requirements include:
- Showing evidence of persecution (or why you fear persecution) in your home country
- Demonstrating that the persecution is based on one of the protected grounds mentioned above
- Illustrating that your government cannot or will not shield you from persecution
- Filing for asylum within one year of arriving in the US (with some exceptions)
Types of Asylums
You can seek affirmative or defensive asylum. Affirmative asylum is for those who are not in removal proceedings. To apply for it, you will submit documents to the Department of Homeland Security (DHS) and attend an interview, during which an official will determine if you meet the US's definition of a refugee. Defensive asylum is an option for those facing the threat of removal (deportation).
