Types of Family Visas We Handle
Generally, there are two types of family visas available to foreign nationals with familial ties to the US, which we detail below:
Immediate Relative Visas
These visas are reserved for close family members of US citizens, such as:
- Spouses
- Unmarried children (under 21 years old)
- Parents
The US does not limit the number of immediate relative visas it issues. This means if your relative qualifies, they should be able to get one without a significant waiting period.
Family Preference Visas
Family preference visas have limited availability and are subject to annual quotas.
They are available to the following relatives of US citizens or Green Card holders:
- Unmarried children over 21 years old
- Married children of any age
- Siblings (if the US citizen sponsor is at least 21 years old)
- Spouses (of Green Card holders)
- Unmarried children of any age (for Green Card holders)
Obtaining Family Visas: Adjustment of Status & Consular Processing
The process for obtaining a family visa depends on if your family member is already inside the US or still residing abroad. If they are in the US, you will petition for them to adjust their status. If they are abroad, consular processing is necessary.
Adjustment of Status
If your relative is already inside the US and eligible to adjust their status, they can apply for a Green Card without returning to their home country. This process generally involves filing Form I-130, Petition for Alien Relative; Form I-485, Application to Register Permanent Residence or Adjust Status; and supporting documents.
Common eligibility requirements for adjustment of status include:
- Being in lawful immigration status at the time of filing (exceptions apply)
- Having an approved immigrant petition
- Visa availability (for family preference categories)
Consular Processing
For relatives outside the US, the first step in obtaining a family visa is to have an approved immigrant petition. As the US sponsor, you will file Form I-130, Petition for Alien Relative, and other documents with USCIS. Once the petition is approved, it will be forwarded to the National Visa Center (NVC) for further processing.
Some common steps in consular processing include:
- Gathering and submitting necessary civil and financial documents
- Attending an interview at the US embassy or consulate in their home country
- Receiving an immigrant visa (if approved)
