Defining Naturalization
Naturalization in the US is the process through which someone who was not born a US citizen becomes one. It usually involves meeting certain requirements, like living in the country for a specific amount of time, passing a test about US history and government, and taking an oath of allegiance to the country.
More on the Naturalization Process
To start the naturalization process, you need to be at least 18 years old and have a Green Card (i.e., be a lawful permanent resident). Then, you must fill out an application (Form N-400) that inquires about your background, criminal record, and eligibility. You also submit other forms and documents detailing biographical information. Once submitted, the US Citizenship and Immigration Services (USCIS) will review your application to make sure it is complete.
Next comes the interview process. The USCIS will schedule a time for you to speak with an officer who will test your English skills, ask more questions about your background, and give you a civics test. This test asks questions about the US government, history, and geography.
You will also need to pass a background check and attend a naturalization ceremony where you take an oath of allegiance to the US. After that, you will receive your Certificate of Naturalization, which serves as proof of your US citizenship.
Who Is Eligible for Naturalization?
Not everyone can become a naturalized US citizen. You must meet certain eligibility requirements, such as:
- Being at least 18 years old
- Having a Green Card for at least five years (or three if married to a US citizen)
- Being of good moral character
- Being able to speak, read, and write basic English
- Passing the civics test
- Residing continuously in the US for at least five years prior to filing for naturalization (three if married to a US citizen)
However, there are some exceptions and exemptions to these requirements. For example, those who have served in the military may be exempt from certain requirements.
Five Common Challenges During Naturalization
Naturalization may be one of the most significant milestones in your immigration journey. Like any journey, however, it is rarely without challenges. At The Fogle Law Firm, LLC, we have guided numerous clients through naturalization and assisted them in facing—and overcoming—various challenges.
Some of the most common include:
- Assessing eligibility - Extended absences from the US, issues with taxes, and more can all affect your eligibility for naturalization.
- Difficulty gathering necessary documents - The USCIS requires numerous forms and supporting documents to complete naturalization. If you have traveled extensively or have a complicated immigration history, obtaining these papers can be challenging.
- Language barriers - One of the naturalization requirements is being able to read, write, and speak English. Of course, this can be very difficult for applicants who are still learning the language.
- Failing the civics test - The civics test is an essential part of the naturalization process, but it can also be intimidating for many.
- Legal complications - Depending on your specific situation, you may encounter legal issues that complicate your naturalization process. This could include prior criminal convictions or discrepancies in your immigration documents.
