The Three EB-1 Subcategories

The EB-1 classification covers three distinct pathways, each with its own eligibility standard. Knowing which one fits your record is the first step toward a successful petition.

EB-1A: Extraordinary Ability

EB-1A is available to individuals who have demonstrated sustained national or international acclaim in the sciences, arts, education, business, or athletics. No job offer is required; an EB-1A applicant may self-petition. Qualification requires either a one-time major internationally recognized achievement or meeting at least three of ten USCIS regulatory criteria, which include significant prizes, scholarly publications, peer review roles, original contributions of major significance, and high salary relative to peers in the field.

EB-1B: Outstanding Professors & Researchers

EB-1B covers professors and researchers who are internationally recognized in their academic field and have at least three years of teaching or research experience. A permanent position offer from a qualifying U.S. university or research institution is required. Applicants must satisfy at least two of six USCIS criteria, including major prizes, membership in qualifying associations, peer review service, and authorship of scholarly articles.

EB-1C: Multinational Executives & Managers

EB-1C applies to executives and managers transferring to a related U.S. entity from a qualifying foreign employer. The applicant must have worked for the organization abroad in a managerial or executive role for at least one year within the three years preceding the petition, and the U.S. entity must have been operating for at least one year. How We Approach an EB-1 Petition

An EB-1 petition is a structured legal submission that must connect your specific achievements to USCIS adjudication standards. The difference between an approved petition and a request for evidence (RFE) often comes down to how thoroughly that connection is made. We start with an eligibility review that identifies which EB-1 subcategory fits your record and which criteria you can support with documentation.

Evidence Strategy & Petition Preparation

From there, we build your evidence package. For EB-1A and EB-1B petitions, that means organizing publications, citation records, award documentation, peer review letters, media coverage, and other materials into a coherent narrative for the USCIS adjudicator. USCIS applies the Kazarian two-step analysis to these petitions: first confirming that the minimum criteria count is met, then evaluating the totality of evidence to determine whether the petitioner reaches the required level of distinction. Meeting the criteria count alone isn’t sufficient, which is why the framing and quality of supporting evidence matter.

I-140 Filing & Post-Filing Support

We handle preparation and filing of the I-140 petition and monitor your case through adjudication. If USCIS issues an RFE, we manage both the response strategy and the preparation, with a thorough submission made on time. Premium processing is available for EB-1A and EB-1B petitions, allowing USCIS to issue a decision on the I-140 within 15 business days. For EB-1C, premium processing targets a 45-business-day decision.

After I-140 approval, eligible applicants may proceed to adjustment of status within the United States or consular processing abroad. EB-1 generally carries more favorable priority date availability than lower-preference categories for most nationalities.
